Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota, was held on the 7th day of
April , 19 80 . The following members were present- mor Hunt,
of Councilmembers Davenport, Hoyt, Neils and Schneider
ng members were absent: None
Councilmember Schneider introduced the following Resolution and moved
is adoption:
RESOLUTION NO. 80- 233
APPROVING VARIANCES FROM SUBDIVISION CODE AND URBAN DEVELOPMENT POLICY RESOLU-
TION NO. 75-664 FOR KEITH GASPARD TO PERMIT A PROPERTY DIVISION CREATING A 5.02
ACRE PARCEL IN THE SOUTHWEST QUADRANT OF THE INTERSECTION OF TROY LANE AND
COUNTY ROAD 47 (80014)
WHEREAS, Keith Gaspard has requested variances from the Subdivision Code and from
the Urban Development Policy No. 75-664 to allow creation of a 5.02 acre parcel
in the unserviced area in the southwest quadrant of Troy Lane and County Road 47
for purposes of building a single family dwelling; and,
WHEREAS, the Planning Commission has reviewed said request and has recommended
approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the variances from the Subdivision
Code and Urban Development Policy No. 75-664 for Keith Gaspard to allow the property
division creating a 5.02 acre parcel in the southwest quadrant of the intersection
of Troy Lane and County Road 47 as follows:
EXISTING LEGAL DESCRIPTION
That part of the East 1/2 of the Northwest 1/4 of Section 6, Township 118, Range 22,
described as follows: Beginning at a point on the West line of said East 1/2 of the
Northwest 1/4 distant 1120.2 feet South from the Northwest corner thereof; thence at
a right angle bearing East 275.0 feet; thence South 77 degrees, 30 minutes East a
distance of 1060.06 feet more or less to the East line of said East 1/2 of the North-
west 1/4; thence Southerly along said East line 395.5 feet more or less to its inter-
section with a line drawn parallel with and 921.5 feet North of the South line of
said East 1/2 of the Northwest 1/4; thence West parallel with said South line to said
West line; thence North along said West line 602.67 feet to the point of beginning.
Hennepin County, Minnesota. Containing 15.66 acres more or less including road.
To be divided into two new parcels as follows:
PARCEL A: That part of the East 1/2 of the Northwest 1/4 of Section 6, Township 118,
Range 22, described as follows: Beginning at a point on the West line of
said East 1/2 of the Northwest 1/4 distant 1120.2 feet South from the
Northwest corner thereof; thence at a right angle bearing East 275.0 feet;
thence South 77 degrees 30 minutes East a distance of 604.85 feet to a
point herein after to be known as point "A"; thence South 17 degrees 15
minutes West a distance of 179.85 feet more or less to its intersection

with a line drawn East from a point in said West line distant 302.67 feet
South from the point of beginning; thence West 812.17 feet more or less to
said West line; thence North along said West line 302.(7 feet to the point
of beginning, containing 5.02 acres more or less. .Together with an ease-
ment over a 30 foot strip of land described as follows: Beginning at point
"A" in the above described parcel; thence South 77 degrees 30 minutes East
a distance of 455.21 feet more or less to the East line of said East 1/2 of
the Northwest 1/4; thence Southerly along said East line to its intersection
with a line drawn parallel to and 30 feet Southerly of a line drawn South
77 degrees 30 minutes East from said point "A"; thence North 77 degrees 30
minutes West along said parallel line to its intersection with a line drawn
South 17 degrees 15 minutes West from said point "A"; thence North 17 degrees
30 minutes East to the point of beginning.
PARCEL B: That part of the East 1/2 of the Northwest 1/4 of Section 6, Township 118,
Range 22 described as follows: Commencing at a point on the West line of
said East 1/2 of the Northwest 1/4 distant 1120.2 feet South from the
Northwest corner thereof; thence at a right angle bearing East 275.0 feet;
thence South 77 degrees 30 minutes East a distance of 604.85 feet to the
actual point of beginning; thence continuing South 77 degrees 30 minutes
East a distance of 455.21 feet more or less to the East line of said East
1/2 of the Northwest 1/4; thence Southerly along said East line 395.5 feet
more or less to its intersection with a line drawn parallel to and 921.5
feet North of the South line of said East 1/2 of the Northwest 1/4; thence
Westerly parallel with said South line to said West line; thence North
along said West line to a point 302.67 Feet from the point of Commencing;
thence at a right angle bearing East distant 812.17 feet mare or less to
its intersection with a line drawn South 17 degrees 15 minutes West from
the point of beginning; thence North 17 degrees 15 minutes East a distance
of 179.85 feet more or less to the point of beginning, containing 10.64
acres more or less. Subject to an easement over the 30 feet adjacent to
and Southerly of the line bearing South 77 degrees 30 minutes East from
the point of beginning to its intersection with the east line of said East
1/2 of the Northwest 1/4.
FURTHER, that the City Manager be authorized to make the necessary special assess-
ment corrections based upon City policy when the division is approved by Hennepin
County.
