Pursuant to due call and notice thereof, a rhe ular meeting of
the City Council of the City of Plymouth,innh(T esota was held on the
7th day of April , 19 80. The following members were
present: Mayor Hunt Councilmembers Davenport, Hoyt, Neils and Schneider

Counci_tmember Schneider_ introduced the following Resolution and
moveditsoption:
RESOLUTION NO, 80- 222-A
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF FINAL PLAT FOR "PLYMOUTH OFFICE
COMMERCIAL PARK" AND PRIOR TO PUBLICATION OF REZONING ORDINANCE FOR REMBRANDT
ENTERPRISES/HEWITT PETERSON (79025)
WHEREAS, the City Council has approved the final plat and development contract
for "Plymouth Office Commercial Park" as requested by Rembrandt Enterprises/
Hewitt Peterson at the northwest corner of County Road 9 and I-494; and,
WHEREAS, the City Council has approved the rezoning of the subject property
from R-0 (restricted residential subdivision district) to B-1 (office limited
business district);
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLY-
MOUTH, MINNESOTA, that it should and hereby does direct the following prior to
recording of said plat and prior to publication of said rezoning ordinance:
1. Compliance with the City Engineer's Memorandum.
2. Appropriate documents describing the 100 foot wide trail easement under the
NSP power lines and a 30 foot trail easement along the north side of County
Road 9 as indicated on approved plans shall be submitted to the City.
3. Compliance with the requirements of the City Attorney's letter of June 8,
1979 with respect to clarification of title matters.
4. A cul-de-sac easement as approved by the City Engineer shall be provided
where Berkshire Lane intersects the north boundary of the property.
5. Developer shall acquire and submit to the City for review a drainage ease-
ment along the natural drainage way northerly of this property to the large
marsh area opposite Curtis Lake. In the event such easement cannot be
acquired by the petitioner, he shall petition the City to continence condemna-
tion proceedings to acquire such easement which is required for drainage of
this project.
6. The ordinance rezoning this property shall be published upon evidence that
the final plat has been filed and recorded with Hennepin County.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Hoyt and upon vote being taken thereon, the
T•olTowing voted to favor t ereo Mayor Hints Councjlmem�ers Davenuort.
