The following memhers were present: Mayor Hunt, Councilmembers Davenport, Hoyt, Neils and Schneider The following members were absent: None Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 80-215 AUTHORIZING THE VACATION OF 62ND AVE. FROM HEMLOCK LANE TO PIKE LAKE IN MORRISONS LAKE VIEW ADDITION WHEREAS, a petition was received to vacate 62nd Ave. from Hemlock Lane to Pike Lake in Morrisons Lake View Addition; and WHEREAS, a public hearing with respect to said vacation was held on April 7, 1980 in accordance with Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of April 7, 1980; and WHEREAS, the Council did hold a public hearing on April 7, 1980 to inform any and all interested parties relevant to the vacation of 62nd Ave. from Hemlock Lane to Pike Lake in Morrisons Lake View Addition; and WHEREAS, it was determined by the City Council that a certain portion of 62nd Ave. is not needed for a public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. That the following portion of 62nd Ave. be vacated as public roadway. All that part of 62nd Ave. platted in Morrisons Lake View Addition between Hemlock Lane and Pike Lake. 2. That said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. 3. That the City reserves a drainage easement over the entire vacated street. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Hoyt , and upon vote being taken thereon, the following voted to favor thereof: Mayor Hunt, Councilmembers Davenport, Hoyt, Neils and Schneider The following voted against or abstained: None Whereupon the Resolution was declared duly passed And adopted.
