HomeMy WebLinkAboutCity Council Resolution 1980-213CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on tthe 7th day of _ April , 19 80. The following members were present: Mayor Hunt, Councilmembers Davenport, Hoyt, Neils and Schneider The following members were absent. None er Hoyt introduced the following Resolution and moved its adoption: RESOLUTION NO. 80-213 AUTHORIZING THE VACATION OF A DRAINAGE AND UTILITY EASEMENT PLAYHOUSE INDUSTRIAL PARK, 2ND ADDITION WHEREAS, a petition was received to vacate a drainage and utility easement in Playhouse Industrial Park, 2nd Addition; and WHEREAS, a public hearing with respect to said vacation was held on April 7, 1980 in accordance with Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of April 7, 1980; and WHEREAS, the Council uir' hold a public hearing on April 7, 1980 to inform any and all interested parties relevant to the vacation of a drainage and utility easement in Playhouse Industrial Park, 2nd Addition; and WHEREAS, it was determined by the City Council that a certain drainage and utility easement in Playhouse Industrial Park, 2nd Addition is not needed; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. That the following drainage and utility easement be vacated: Six (6) feet on either side of the common lot line between Lots 1 and 2, Block 1, Playhouse Industrial Park, 2nd Addition. 2. That said vacation shall not affect the authoy;ty of any person, corporation, or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Schneider and upon vote being taken thereon, the T0110wing vote-cl in favor thereof: y Hunt, Councilmember Davenport, Hoyt, Neils and Schneider . The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
