The following members were present: Mayor Hunt, ounc_i me ers ayenpo—r-f; Hoyt, Neils and Schneider The following members were absent: None kw,r w,r* **t Councilmember Hot introduced the following Resolution and moved is adoption: RESOLUTION NO. 80- 165 REQUEST FOR PAYMENT NO. 6 AND FINAL PROJECT NO. 611 - PHASE I, DOWNTOWN PLYMOUTH STREETS WHEREAS, the City of Plymouth as Owner and Veit & Company as Contractor have entered into an agreement for the improvement of the Phase I, Downtown Plymouth streets by the construction of street improvements, said agreement being dated October 17, 1977; and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the Final Request for Payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $236,586.13; Change Order No. 1 was approved in the amount of $32,880.00, making a revised contract amount of $269,466.13, and the value of the work completed to date ' is $287,589.62. 2. That the work performed by the Contractor for Project No. 611 and certified to the Council by the Engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the owner, required guarantees and Correction of Faulty Work after Final Payment. 3. Request for Payment No. 6 and fit:al in the amount of $29,733.80 to Veit & Company for Project No. 511 is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith.
