Pursuant to due call and notice thereof, a special meeting
of the City Council of the City of Plymouth, Minnesota, was held on
the 25th day of February - , 1980. The following members
were present: Mayor Hunt, Councilmembers Davenport, Hoyt, Neils
and Schneider
The following members were absent: one
Councilmember Neils introduced the following resolution and
moved its adep 1t on: `�
RESOLUTION NO. 80-133
A RESOLUTION AUTHORIZING
EMINENT DOMAIN PROCEEDINGS
CIMARRO.N PONDS ADDITION
WHEREAS, prior to the platting of Cimarron Ponds Addition, it was
determined that lana was needed .for right-of-way for a trail corridor;
and
WHEREAS, the development contract between the develoeer of Cimarron
Ponds, Centurion Company, Inc. and the City of Plymouth, provided
for the dedication of outlot B, Cimarron Ponds, to the City of Plymouth
to be used for a trail ccrridorp and
WHEREAS, it has been discovered that subsequent to the execution
of the development contract, Outlot B was conveyed to the Homeowners
Association rather than the City of Plymouth; and
WHEREAS, the Homeowners Association has brought an action seeking to
block construction of the trail by Centurion or by the City as long "
as they hold title to said Outlot a; and
WHEREAS, said trail is an integral part of the city's trail system;
and
WHEREAS, the City Council finds it necessary, proper and expedient
in the interest of the public health, convenience and general welfare
of the citizens of the City of Plymouth for the City to acquire said
outlot.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA that the City Attorney is hereby authorized
and directed to commence condemnation proceedings to acquire Outlot B,
Cimarron Ponds, for the purpose of constructing a trail corridor.
The motion for the adoption of the foregoing resolution was duly
seconded by o ncilmember-Hoyt , and upon vote being taken
thereon, the following voted in favor t ereo
