The following members were present: Mayor Hunt, Councilmembers Davenport, Hoyt, Neils and Schneider The following members were absent: None **t Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 80-49 DECLARING ADEQUACY OF PETITION AND ORDERING PREPARATION OF REPORT STREET LIGHTING - FOX GLEN ADDITION WHEREAS, a petition has been received from Zachman Homes, Inc. requesting installation of ornamental residential street lighting in the Fox Glen Addition; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. A certain petition requesting the improvement of Fox Glen Addition by the installation of residential ornamental street lighting, filed with the City Council on January 14, 1980, is hereby delcared to be signed by the required percentage of owners of property affected thereby. This declaration is made in conformance to Minnesota Statutes Section 429.035. 2. The petition is signed by 100% of the affected property owners and they have waived their rights to public improvement and special assessment hearings. 3. The petition is hereby referred to the City Engineer and he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in conjunction with some other improvement and the estimated cost of the improvement as recommended. The motion for the adoption of the foregoing Resolution was duly seconded by' Councilmember Ho tand upon vote being taken thereon, the following voted to favor thereof: Mayor Hunt.
