The following members were present: Ma or Hunt Councilmembers Daven ori, Hoyt, Neils and Schneider The follow ng mem ers were absent: one Councilmember Hoyt introduced the following Resolution and moved its adoption: RESOLUTION NO. 80-30 REQUEST FOR PAYMENT NO. 5 AND FINAL 1978 STREET IMPROVEMENTS WHEREAS, the City of Plymouth as Owner and Hardrives, Inc. as Contractor have entered into an agreement for the 1978 Street Improvements, said Agreement being dated July 28, 1978; and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the Final Request for Payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $167,884.60; Change Order No. 1 was approved in the amount of ($7,461.00) a deduction, making a revised contract amount of $160,423.60, and the value of the work com- pleted and certified to date is $147,784.34. 2. That the work performed by the Contractor for 1978 Street Improvements and certified to the Council by the Engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the Owner, required guarantees and Correction of Faulty Work after Final Payment. 3. Request for Payment No. 5 and Final in the amount of $35,699.38 to Hardrives, Inc. for 1978 Street Improvements is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following voted in favor thereof: Mayor Hunt, Councilmembers Davenport, _ Hoyt, Neils and Schneider The following voted against or abstained: one Whereupon the Resolution was declared duly passed and adopted.
