RESOLUTION NO. 79-786
APPROVING CONDITIONAL USE PERMIT FOR TERRY MAHONEY REPRESENTING ZACHMAN HOMES
TO USE A MODEL HOME TO BE BUILT ON THE NORTHEAST CORNER OF 39TH AVENUE NORTH AND
FERNBROOK LANE AS A TE"IORARY SALES OFFICE (A-814)
WHEREAS, Terry Mahoney representing Zachman Homes has requested approval of
a conditional use permit to use a model home to he built on the northeast corner
of 39th Avenue North and Fernbrook Lane as a temporary sales office; and,
WHEREAS, the Planning Commission has reveiwed said request and recommended
approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Ply-
mouth, Minnesota, that it should and hereby does approve the request of
Terry Mahoney representing Zachman Homes for a conditional use permit to use
a model home to be built on the northeast corner of 39th Avenue North and
Fernbrook Lane as a temporary sales office subject to the following conditions:
1. Off-street parking from 39th Avenue North shall be provided as soon as
the street right-of-way has been improved so to be in a passable condition.
2. The off-street parking area for the model home/sales office shall be paved
and shall be located in accordance with City standards.
3. A performance guarantee shall he submitted to assure restoration of the
Lot 2, Block 1 model home site when the use of the temporary sales office
is terminated.
The motion for the adoption of the foregoing Resolution was duly seconded by
r Hunt and upon vote being taken thereon, the
