Pursuant to due call and notice thereof, a re ular meeting of
the City Council of the City of Plymouth,inM� nesota was held on the
5thday of November , 19 79 - The following members were
present: ^ Councilmembers Davenport, Hoyt, Neils and Spaeth
The following memT ers were absent: Mayor Hunt
Councilmember Hoyt introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 79-727
APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR "AMHURST FIRST ADDITION"
RPUD 79-2 FOR BAN CON, INCORPORATED (79046)
WHEREAS, Ban Con, Incorporated has requested approval of the final plat for
"Amhurst First Addition" RPUD 79-2, a plat for seven single family lots
located north of Turtle Lake and east of Vicksburg Lane and a development
contract therefore; and,
WHEREAS, the Planning Commission has reviewed said request and recommends its
approval; and,
WHEREAS, City staff has prepared a development contract covering the improve-
ments related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Ply-
mouth, Minnesota, that it should and hereby does approve the request of Ban
Con, Incorporated for final plat approval of "Amhurst First Addition" RPUD 79-2,
a plat for seven single family lots located north of Turtle Lake and east of
Vicksburg Lane;
FURTHER, that the Development Contract for said plat be approved and that the
Mayor and City Manager be authorized to execute the Development Contract on
behalf of the City;
FURTHER, the developer shall petition for the full urban improvement of
Vicksburg Lane adjacent to the plat and agree to the assessment for the
ultimate urban construction of Vicksburg Lane for one side of the roadway,
and to adapt the assessments which will be charged to the entire RPUD 79-2.
The motion for the adoption of the foregoing Resolution was duly seconded by'
Councilmember Davenport , and upon vote being taken thereon, the

Whereupon the Resolution was declared duly passed and adopted.
