The following members were present: The o owing mem euyrs were a sent: o e Councilmember Spaeth introduced the following Resolution and moved Its a op on: RESOLUTION NO. 79- 709 APPROVING CONDITIONAL USE PERMIT RENEWAL FOR CHARLES CARLSON TO OPERATE THE FUN & GAMES AMUSEMENT CENTEk AT 3435 NORTH COUNTY ROAD 18 (A-508) WHEREAS, Charles Carlson nas requested a renewal of the conditional use permit to operate the Fun & Games Amusement Center at 3435 North County Road 18; and, WHEREAS, the Planning Commission has reviewed said request; NOW, THEREFORE, BE IT HEREBY RESOLVED by the Citv Council of the City of Ply- mouth, Minnesota, that it should and hereby does approve the request of Charles Carlson for a conditional use permit renewal to operate the Fun & Games Amusement Center located at 3435 North County Road 18 subject to the following conditions: 1. Compliance with all applicable construction codes and ordinances; 2. No smoking shall be allowed within the building on the site and reason- able effort shall be used to discourage smoking in the parking lot and outside of the building; 3. Patrons must be 15 years of age or older unless accompanied by parent or legal guardian; 4. Hours of operation of'the Amusement Center shall be: Monday through Thursday 4:30 to 10:00 PM Friday 4:30 to 12 midnight Saturday and school holidays and vacations 10:00 AM to 12 midnight Sunday 12:00 noon to 10:00 PM 5. No more than 40 persons shall be allowed in the building at one time; 6. Two adults shall be on duty at all times. 7. A renewed performance guarantee shall be submitted to the City Covering 150 percent of the cost of the private improvements to the property (landscaping) to be termed through September 15, 1981 to assure maintenance and upkeep of the improvements.
