The following members were present: Mayor Hunt. Counc'lmembers Davenport. Hoyt, Neils and Spaeth The follow ng members were a sen : None Councilmember Spaeth _ introdl:c,ed the following Resolution and moved its adoption: RESOLUTION NO. 79-700 AUTHORIZING THE VACATION OF A PORTION OF CHESHIRE LANE NORTH OF 23RD AVENUE WHEREAS, a petition was received to vacate a portion of Cheshire Lane North of 23rd Avenue; and WHEREAS, a public hearing with respect to said vacation was held on October 22, 1979 in accordance with Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of October 22, 1979; and WHEREAS, the Council did hold a public hearing on October 22, 1979 to inform any and all interest parties relevant to the vacation of a portion of Cheshire Lane North of 23rd Avenue; and WHEREAS, it was determined by the City Council that a portion of Cheshire Lane North of 23rd Avenue is not needed for a public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. That the following portion of Cheshire Lane be vacated as public roadway: A 50.00 foot easement for street purposes over, under and across the Easterly 50.00 feet of the following described property: That part of the Southeast Quarter of the Northwest Quarter of the Northwest Quarter of Section 27, Township 118, Range 22, Hennepin County, Minnesota, lying West of the West line of U.S. interstate Highway No. 494 2. That said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto.
