Pursuant to due call and notice thereof, a —regular meeting of the City
Council of the City of Plymouth, Minnesota, was held on t e 1st day of
October , 19 79 . The following members were present: Mayor Hunt,
Councilmembers Daven ort Hoyt and Neils
The T-6113wing members were absent: Councilmember Spaeth
Councilmember Neils introduced the following Resolution and moved
is adoption: -
RESOLUTION NO. 79-639
APPROVING PRELIMINARY PLAT FOR HENRY FABER AT THE NORTHEAST QUADRANT OF WEST
MEDICINE LAKE DRIVE AND 28TH AVENUE NORTH (79064)
WHEREAS, Henry Faber has requested approval of rezoning from RO to R -1A and a
preliminary plat for twelve (12) single family residential lots and three (3)
outlots of the approximately 11.6 acre tract at the northeast quadrant of West
Medicine Lake Drive and 28th Avenue North to be known as "Faber Place"; and,
WHEREAS, the Planning Commission has considered the request following a duly
called public hearing and has recommended approval;
NOW, THEREFORE BE IT HEREBY RESOLVED by the City Council of the City of Plymouth,
Minnesota that it should and hereby does approve the preliminary plat for twelve
(12) single family residential lots and three (3) outlots at the northeast quad-
rant of West Medicine Lake Drive and 28th Avenue North, to be known as "Faber
Place" subject to the following conditions:
1. Compliance with the City Engineer's Memorandum;
2. Conveyance to the City of Outlot A and Outlot D for right-of-way and
utility purposes;
3. Private drive and access to West Medicine Lake Drive shall be prohibited;
4. All yard setbacks shall be according to Ordinance minimum standards and
lots shall be redesigned so that the -Ordinance 15 foot side yard setback
can be met;
5. Payment of Park Dedication Fees in lieu of land dedication in accordance
with City policy in effect at the time of final platting;
6. No building permits to be issued until municipal utilities are physically
available to the property;
7. Compliance with City Council Policy Resolution No. 79-80 regarding sub-
divisions containing or adjacent to storm water holding facilities;
B. Removal or demolition of all structures not.in conformance with City
ordinance standards;

9. A covenant shall be placed on the title to Outlot C to indicate that
the use of the outlot is intended to facilitate the development and
design of the property to the south; t.
10. Rezoning shall be finalized at the time of final platting.
