Councilmembers Davenport, Hoyt, Neils and Spaeth The following mempers were a sent: None Councilmember Spaeth introduced the following Resolution and moved its adoption: RESOLUTION N0, 79-620 ORDERING HEARING TO CONSIDER REVOCATION OF CONDITIONAL USE PERMIT FOR JUDY'S RESTAURANT AT 14420 28TH PLACE NORTH (A-802). WHEREAS, the City Council under Resolution No. 78-174 approved a site plan and conditional use permit for Judy's Restaurants, Inc. for a Class II restaurant involving a drive up window and remote order station at 14420 28th Place North; and, WHEREAS, the City has received complaints about and has observed substantial traffic congestion beyond the limits of the property into the public right-of- way, said congestion being attributed to the drive up window and remote order station operation; and, WHEREAS, such traffic congestion in the public right-of-way is in violation of the City Code and the operation causing such congestion is not consistent with the intent of the conditional use permit provisions of Section 9 of the Zoning Ordinance; and, WHEREAS, the Planning Commission has reviewed this matter and has recommended scheduling a hearing for formal consideration of revocation of the conditional use permit; NOW THEREFORE BE IT HEREBY RESOLVED BY the City Council of the City of Plymouth, Minnesota, that it should and hereby does establish a public hearing for October 22, 1979 at 7:30 p.m. at which time the Judy's Restaurant, Inc. shall have the opportunity to show cause why the conditional use permit for the drive up window facility and remote order station for the Class II restaurant at 14420 28th Place North should not be suspended or revoked.
