Councilmember Davenport introduced the following Resolution and
moved its adoption:
RESOLUTION NO, 79-578
APPROVING VARIANCE FOR STUART THORSON TO BUILD A GARAGE TO WITHIN 5.5 FEET OF
THE PROPERTY LINE AT"14435 13TH AVENUE NORTH
WHEREAS, in accordance with provisions of the Plymouth Zoning Ordinance,
Stuart K. Thorson has submitted an appeal dated September 4, 1979 from the
ruling of the Board of Zoning Adjustments and Appeals of August 14, 1979
that his request for a side yard variance at 14435 - 13th Avenue North be
denied; and,
WHEREAS, the petitioner presented information to the City esdri i— b ng
the proposed construction of a garage which had not been p sented to the
Board of Zoning Adjustments and Appeals because the petiti ner was not able
to attend that hearing and had been represented instead by a neighbor;
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Ply-
mouth, Minnesota, that it should and hereby does approve a variance for Stuart
Thorson to build a garage to within 5.5 feet of the property line at 14435 -
13th Avenue North for the following reasons:
1. The existance of a storm water sewer line in the back yard.
2. The neighbor's setback to the west is substantially deep so not to be
impacted negatively.
3. The nearest structure to the west is at least 60 feet south of the
proposed garage.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Ne is and upon vote being taken thereon, the
following voted in favor t ereo Mayor Hunt. Counpilm mhers Neils.
Davenport and Spaeth.
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
