The following members were _ers present: Mayor Hunt, Counci mem Royt, nth and Neils The following memmbers were absent: Gounci I mem er avenpor Councilmember Spaeth introduced the following Resolution and moved its adoption: RESOLUTION N0, 79-535 DECLARING ADEQUACY OF PETITION AND ORDERING PREPARATION OF REPORT STREET LIGHTING - HERITAGE ESTATES ADDITION WHEREAS, a petition has been received from the developer requesting installation of ornamental residentail street lighting in the Heritage Estates Addition; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. A certain petition requesting the improvement of Heritage Estates Addition by the installation of residential ornamental street lighting, filed with the City Council on September 4, 1979, is hereby declared to be signed by the required percentage of owners of property affected thereby. This declaration is made in conformance to Minnesota Statutes Section 429.035. 2. The petition is signed by 100% of the affected property owners and they have waived their rights to public improvement and special assessment hearings. 3. The petition is hereb;, referred to the City Engineer and he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in conjunction with some other improvement and the estimated cost of the improvement as recommended. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote beintaken the eon, the following vote in favor thereof: mayor Hunt, Councilmelers Hoyt If Spaeth The following voted AWMXX)Wt abstained: Councilmember Neils Whereupon the Resolution was declared duly passed and adopted.
