Pursuant to due call and notice thereof, a special meeting of
the City Council of the City of Plymouth, Minnesota was heT�n the

Councilmember Neils introduced the following Resolution and
moved its adoption:

REVISING RESOLUTION NO. 79-447
SETTING CONDITIONS PRIOR TO FILING OF FINAL PLAT FOR CRITERION MPUD 78-1
WHEREAS, the City Council by Resolution 79-447 set conditions which must be
met prior to filing of the Criterion MPUD 78-1 Plat, and
WHEREAS, because of revision to the development contract it is necessary to
revise the conditions set in Resolution 79-447,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that Resolution 79-447 is revised as follows:
I. Delete Condition No. 9.
2. Add a new Condition No. 9 as follows: Prior to issuance of building
permits on the lots which abut Annapolis Lane, grading and drainage
plans shall be submitted and approved by the City Engineer. This
approval is to ensure that the lot grades are compatible with the
proposed street grade of Annapolis Lane and surface drainage is
accommodated.
3. The developer agrees to provide a waiver of hearing for public improve-
ment and assessmPnis fcr ,."InilQlolis Lane, which waiver shall be included
in the development contract. The waiver shall provide that if the
developer does not proceed with the improvement on Annapolis Lane, the
City can proceed with the work during the 1981 construction season.
The decision for the City to proceed with the work will be made by
September 1980.
