HomeMy WebLinkAboutCity Council Resolution 2009-308CITY OF PLYMOUTH RESOLUTION No. 2009-308 A RESOLUTION AUTHORIZING THE VACATION OF A PORTION OF A PLATTED DRAINAGE Et UTILITY EASEMENT WITHIN LOT 5, BLOCK 1, IMPERIAL HILLS 6TH ADDITION WHEREAS, a public hearing with respect to said vacation was scheduled for December 8, 2009 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of December 8, 2009; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the City Council did hold a public hearing on December 8, 2009 to inform any and all interested parties relevant to the vacation of that portion of the platted drainage and utility easement within Lot 5, Block 1, Imperial Hills 6th Addition; and WHEREAS, it was determined by the City Council that said easement is not needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following portion of said drainage and utility easement within Lot 5, Block 1, Imperial Hills 6th Addition be vacated: That part of the 40 -foot platted drainage and utility easement located within Lot 5, Block 1, Imperial Hills 6th Addition lying 12.0 feet westerly -southwesterly of the following described line: Commencing at the northeast corner of said Lot 5; thence southwesterly along the northerly line of said Lot 5 to the intersection with the northerly extension of the easterly line of the 40 -foot platted drainage and utility easement which is the point of beginning of said easement: Thence southeasterly along the easterly line of said easement a distance of 50.0 feet and there terminating. Except the northerly 5 feet of said easement. RESOLUTION No. 2009-308 FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
