The following members were present: were Councilmember Spaeth introduced the following Resolution and moved its adoption: RESOLUTION NO. 79-490 APPROVING RPUD CONCEPT PLAN FOR "HARRISON HILLS" FOR PETERSON PROPERTIES . AT THE SOUTHEAST CORNER OF ZACHARY LANE AND COUNTY ROAD 10 (79055) WHEREAS, Peterson Properties has requested approval of a residential planned unit Development Concept Plan for "Harrison Hills" on approximately 82.9 acres at the Southeast corner of Zachary Lane and County Road 10; and, WHEREAS, the Planning Commission has reviewed the proposal at a duly called Public Informational Meeting and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Concept Plan for "Harrison Hills" RPUD for Peterson Properties at the Southeast corner of Zachary Lane and County Road 10, subject to the following conditions: 1. Completion of the Environmental Accessment Worksheet Process. 2. Compliance with the City Engineer's Memorandum and staging of development in accordance with utility availability as approved by the City Engineer. 3. Approval is based upon the existing LA -2 Guiding of the entire property; no reguiding of any portion is approved. 4. Substantial buffering through the use topography and plantings will be provided along the North perimeter of the property and berming landscaping and setback shall be used to provide buffering from the railroad right-of-way along the South perimeter. 5. Approved density for this project shall be exclusive of the wetland area, as verified by the City Engineer, and in consideration of the assigned density Bonus Points as follows, per Section 9 of the Zoning Ordinance: 2 points for project size for a total of 2 points allowing a gross density of 3.4 units per acre. 6. The Northeast area of the project shall be fully integrated with the planned unit development by design, providing for full road access. Resolution # 79-490 Page 2 7. An area road needs analysis be accomplished in conjunction with the City Engineer, especially directed to providing access to the East in a continuous pattern with adjacent area residential land. E. Petitioner shall consider the soil conditions in the Northwest corner of the site due to filling operations. 9. The proposed Northerly intersection with Zachary Lane should be moved further South to the maximum distance possible as verified by the City Engineer. 10. Preliminary Plat Survey of the property should include a survey of existing major stands of trees and shall be used to evaluate the proposed relocation of trees from one portion of the site to another: The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Davenport , and upon vote being taken thereon, the ' following voted in favor thereof: Mayor Hunt, Councilmembers DavgRort. o Taoln7o ng wtea against or abstained: Naga Whereupon the Resolution was declared duly pass .
