The following members were present: Mayor Hunt, Counci mem ers Davenport, Hoyt, Neils and Saaeth The following members were absent: Councilmember Spaeth introduced the following Resolution and move its adoption: RESOLUTION NO. 79-477 AUTHORIZING THE VACATION OF A PORTION OF 37TH AVENUE IN PLYMOUTH HILLS ADDITION WHEREAS, a petition was reserved to vacate a portion of 37th Avenue in Plymouth Hills Addition; and WHEREAS, a public hearing with respect to said vacation was held on August 20, 1979 in accordance with Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of August 20, 1979; and WHEREAS, the Council did hold a public hearing on August 20, 1979 to inform any and all interested parties relevant to the vacation of a portion of 37th Avenue in Plymouth Hills Addition; and WHEREAS, it was determined by the City Council that a portion of 37th Avenue in Plymouth Hills Addition is not needed for a public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. That the following portion of 37th Ave. be vacated as public roadway: All that part of 37th Ave. in Plymouth Hills Addition lying easterly of the following line: Commencing at the southwest corner of Outlot E said Plymouth Hills; thence easterly along the south line of said Outlot E, 539.27 feet to the point of beginning; thence deflect to the right 90 degrees a distance of 60.00 feet and there terminating. 2. That said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. The motion for the adoption of the foregoing Resolution was duly seconded by Coun�Qy , and upon vote being taken thereon, the fo owing voted in favor thereof: Mayor Hunt, Councilmembers Davenport, Hovt, Neils and Saaeth The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
