HomeMy WebLinkAboutCity Council Resolution 1979-476Councilmember Spaeth introduced the following Resolution and moved its adoption: RESOLUTION NO. 79-476 DIRECTING THE CITY CLERK WITH RESPECT TO THE FILING OF RESOLUTION NO. 79-475 WHEREAS, the City Council of the City of Plymouth has authorized the vacation of 27th Ave. from Orleans Lane to Quaker Lane; and WHEREAS, Lot 12, Block 6, Medicine Lake Park 3rd Division requires the temporary right to utilize the southerly one half of said road for driveway purposes until such time as Quaker Lane is opened for public use; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. That the City Clerk is directed to not file the resolution vacating the aforedescribed portion of 27th Ave. until such time as the following condition occurs: a. A valid, recordable temporary easement for driveway purposes over the aforedescribed portion of 27th Ave. in a form acceptable to the City Attorney is provided the City Attorney for filing with the appropriate County officials. The motion for the adoption of the foregoing Resolution was duly seconded by* Councilmember Neils , and upon vote being taken thereon, the following voted in favor thereof: -Mayor Hunt, Councilmembers Davenport, Hoyt, Neils and Spaeth The following voted against or abstained. _on , Whereupon the Resolution was declared duly passed and adopted.
