RESOLUTION No. 2009-306
A RESOLUTION APPROVING AN AMENDMENT TO THE "ELM CREEK HIGHLANDS"
DEVELOPMENT CONTRACT (2009046)
WHEREAS, the City of Plymouth approved a final plat and development contract for the
first nine lots on the roughly 80 acres of land located at the northeast corner of Peony Lane and
Schmidt Lake Road;
WHEREAS, the property is presently legally described as follows:
Lots 1-9, Block 1, and Outlots A and B, Elm Creek Highlands, Hennepin County, MN;
WHEREAS, the City approved a development contract covering the improvements related to
said plat;
WHEREAS, the City Staff has prepared an amendment to paragraph 19 of said development
contract;
WHEREAS, Pulte Homes has executed the amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by the City of Plymouth to amend the development contract for Elm Creek
Highlands and the Mayor and City Manager be authorized to execute the amendment on behalf
of the City; and,
FURTHER, that the City staff record the amendment to the development contract with
Hennepin County.
