Pursuant to due call and notice thereof, a re ularmeeting of
the City Council of the City of Plymouth, Minnesota was held on the
6th day of August , 19 79 . The following members were
present: Mayor Hunt Councilmembers Daven ort, Hoyt and Neils

its adoption:
RESOLUTION 79-450
SETTING CONDITIONS PRIOR TO FILING OF FINAL PLAT FOR FOX GLEN IN OUTLOT D OF
CRITERION MPUD 78-1 FOR ZACHMAN HOMES (A-814)
WHEREAS, the City Council has approved the final plat and development contract
for Fox Glen in Outlot D of Criterion MPUD 78-1 as requested by Zachman Homes,
NOW THEREFORE BE IT HEREBY RESOLVED by the City Council of the City of Plymouth,
Minnesota, that it should and hereby does direct the following prior to re-
cording of said plat:
1. Compliance with City Engineer's memorandum for this project;
2. Payment of park dedication fees in lieu of dedication based upon 54
single family lots in accordance with City Park Dedication Policy at
the time of filing of final plat;
3. Appropriate easements for right-of-way and drainage purposes shall be
made as approved by the City Engineer;
4. All covenants and deed restrictions intended for the subdivision shall
be reviewed and approved by the City Attorney;
5. The area designated as "park" between Lot 12, Block 1 and Lot 1, Block
3 be designated Outlot A and deeded to the City.
6. An assessment roll shall be prepared for the plat; the language of those
assessments shall be contained within the development contract; and there
shall be a waiver of assessment hearing for the proposed assessments.
The motion for the adoption of the foregoing Resolution was duly seconded by
Pq4ncilmAmbPr, and upon vote being taken thereon, the
following vote in favor thereof: Mayor Hunt, Councilmembers Davenport,
Hoyt and Neils
The following voted against or abstained: None
Whereupon the Resolution was declared duly passe and adopted.
