HomeMy WebLinkAboutCity Council Resolution 1979-447CITY OF PLYMOUTH Pursuant to due call and notice thereof, a r�a��lar meeting of the City Council of the City of Plymouth, Minnesota, was herd on t e 6th day of August 1979 . The following members were present: Mayor Hunt, Councilmembers Davenport, Hoyt and Neils The following members were absent: Councilmember Spaeth Councilmember Hoyt introduced the following Resolution and moved s adoption: RESOLUTION NO. 79-447 SETTING CONDITIONS PRIOR TO FILING OF FINAL PLAT FOR CRITERION MPUD 78-1 FOR CRITERION HOMES, INC. (A-814) WHEREAS, the City Council has approved the final plat and development contract for Criterion MPUD 78-1 as requested by Criterion Homes, Inc.; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does direct the following prior to recording of said plat: 1. Compliance with the Engineer's memorandum; 2. Payment of park dedication fees in lieu of dedication for 39 single family lots in accordance with City Council Dedication Policy in effect at time of filing of final plat; 3. Appropriate easements for right-of-way and drainage purposes shall be filed and approved by the City Engineer; 4. All covenants and deed restrictions intended for the subdivision shall be reviewed and approved by the City Attorney; 5. No building permits shall be issued until municipal utilities are physically available to the property; 6. The area designation as "park" between Lot 1, Block 3 and Lot 18, Block 2 shall be eliminated and a 40 ft. wide utility easement shall be granted for emergency vehicle access; 7. The dedicated trail corridor south of County Road 9 within and adjacent to the Annapolis Lane right-of-way shall be classified residential for purposes of determining yard and building setbacks for the commercial and industrial sites to the east; 8. Trail easement adjacent to I-494 shall be granted at final platting; 9. A pending assessment roll shall be prepared for the entire PUD and assess- ments allocated to each of the several parcels within the PUD; the language of those assessments shall be contained within the development contract; and there shall be a waiver of assessment hearing for the proposed assessments. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Davenport, and upon vote being taken thereon, the following vote .in favor thereof: Mayor Hunt, Councilmembers Davenport, Hoyt and Neils. The following voted against or abstained:' None Whereupon the Resolution was declared duly passed and adopted.
