HomeMy WebLinkAboutCity Council Resolution 1979-441CITY OF 'PLYMOUTH Pursuant to due call and notice thereof, a re ular meeting of the City Council of the City of Plymouth, Minnesota was held on the 6th day of August , 1979 . The following members were present: Mayor Hunt, Councilmembers Davenport, Hoyt and Neils The following members were absent: Councilmember Spaeth Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 79-441 DIRECTING THE CITY CLERK WITH RESPECT TO THE FILING OF RESOLUTION NO. 79-440 WHEREAS, the City Council of the City of Plymouth has authorized the vacation of a portion of Peripheral Road northerly from County No. 15; and WHEREAS, the City requires a trail easement over a portion of the vacated right of way; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE -CITY OF PLYMOUTH, MINNESOTA as follows: 1. That the City Clerk is directed to not file the resolution vacating the aforedescribed portion of Peripheral Road until such time as the following condition occurs: a. A valid, recordab'i easement for public trail purposes ovF� the afore - described portion of Peripheral Road in a form acceptable to the City Attorney is provided the City Attorney for filing with the appropriate County officials. The motion for the adoption of the foregoing Resolution was duly seconded by' Councilmember Hoyt , and upon vote being taken thereon, the 70 o -wing voted in favor t erect : ayor Hunt, Councilmembers Davenport, Hoyt and Neils Ine Toilowing voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
