Pursuant to due call and notice thereof, a regular meeting of
the City Council of the City of Plymouth, Minnesota was -field on the
6th day of August , 1979 . The following members were
present: Mayor Hunt Councilmembers Davenport, Hoyt and Neils
The following members were absent: rnunrilmomhar Cnwn+h
Councilmember Hoyt introduced the following Resolution and
move its adoption:
RESOLUTION NO. 79-440
AUTHORIZING THE VACATION OF PERIPHERAL ROAD NORTHERLY FROM COUNTY ROAD 15
WHEREAS, a petition was received to vacate Peripheral Road northerly from County
Road 15; and
WHEREAS, a public hearing with respect to said vacation was held on August 6,
1979 in accordance with Minnesota Statutes 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of August 6, 1979; and
WHEREAS, the Council did hold a public hearing on August 6, 1979 to inform any
and all interest parties relevant to the vacation of Peripheral Road northerly
from County Road 15; and
WHEREAS, it was determined by the City Council that a certain portion of Peripheral
Road is not needed for a Public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. That the following portion of Peripheral Road be vacated as public roadway:
All that part of Peripheral Road North of the North line of County
Road No. 15 and South of previously vacated Peripheral Road which
was vacated by Resolution No. 79-149.
2. That said vacation shall not affect the authority of any person, corporation,
or municipality owning or controlling electric or telephone poles and lines,
gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder,
to continue maintaining the same or to enter upon such way or portion thereof
vacated to repair, replace, remove or otherwise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded by
_Council ember_Neils 'and upon vote being taken thereon, the
following �voted in favor thereof—
: favor Hunt. Councj members Davenport
Hoyt and Neils
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
