HomeMy WebLinkAboutCity Council Resolution 1979-438CITY OF PLYMOUTH Pursuant to due call and notice thereof, aregular meeting of the City Council of the City of Plymouth, Minnesota was held on the 6th day of' Au ust 1979 . The following members were present: Mayor Hunt, Counci mem ers aavveneort, Hoyt and Neils The following mem er6 s were a sen ounciImem6er Snaet Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 79-438 AUTHORIZING THE VACATION OF 43RD AVE. IN GORDON'S OAKWOOD HILLS ADDITION WHEREAS, a petition was reserved to vacat 43rd Ave. in Gordon's Oakwood Hills Addition; and WHEREAS, a public hearing with respect to said vacation was held on August 6, 1979 in accordance with Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of August 6, 1979; and WHEREAS, the Council did hold a public hearing on August 6, 1979 to inform any and all interested parties relevant to the vacation of 43rd Ave. in Gordon's Pakwood Hills Addition; and WHEREAS, it was determined by the City Council that a certain portion of 43rd Ave. is not needed for a public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. That the following portion of 43rd Ave. be vacated as public roadway: All that part of 43rd Avenue platted in Gordon's Oakwood Hills Addition between the West line of Juneau Lane and the East line of Kingsview Lane. 2. That said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such :ray or portion thereof vacated to repair, replace, remove or otherwise attend thereto.
