HomeMy WebLinkAboutCity Council Resolution 1979-436CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 6th day of August , 1979 . The following members were present: Mavor Hunt, Councilmembers Hunt Davenport, Hoyt and Neils The following members were absent: Councilmember Spaeth Councilmembpr Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 79-436 AUTHORIZING THE VACATION OF 19TH AVE. IN KREATZ HIGHVIEW ACRES 6TH ADDITION WHEREAS, the city proposes to vacate 19th Ave. in Kreatz Highview Acres 6th Addition; and WHEREAS, a public hearing with respect to said vacation was held on August 6, 1979 in accordance with Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of August 6, 1979; and WHEREAS, the Council did hold a public hearing on August 6, 1979 to inform any and all interested parties relevant to the vacation of 19th Ave. in Kreatz Highview Acres 6th Addition; and WHEREAS, it was determined by the City Council that a certain portion of 19th Ave. is not needed for a public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. That the following portion of 19th Ave. be vacated as public roadway: All of 19th Avenue platted in Kreatz Highview Acres 6th Addition 30' South of the North line of said addition. 2. That said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. The motion for the adoption of the foregoing Resolution was duly seconded by' Mllmember HQYt and upon vote being taken thereon, the 0 owing voted in favor thereof: Mayor Hunt, Councilmembers Davenport, Hoyt and Neils me following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
