Councilmember Neils introduced the following Resolution and
moved its a option:
RESOLUTION NO. 79-435
AUTHORIZING THE VACATION OF DUNKIRK LANE SOUTH OF 12TH AVE.
WHEREAS, a petition was received to vacate Dunkirk Lane south of 12th Ave.; and
WHEREAS, a public hearing with respect to said vacation was held on August 6,
1979 in accordance with Minnesota Statutes 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of August 6, 1979; and
WHEREAS, the Council did hold a public hearing on August 6, 1979 to inform any
and all interested parties relevant to the vacation of Dunkirk Lane south of 12th
Ave., and
WHEREAS, it was determined by the City Council that a certain portion of Dunkirk
Lane is not needed for a public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. That the following portion of Dunkirk Lane be vacated as a public roadway:
All that part of Dunkirk Lane South of the South line of 12th Ave.
and North of the North line of Lot B, Block 2, City View Acres.
2. That said vacation shall not affect the authority of any person, corporation,
or municipality owning or controlling electric or telephone poles and lines,
gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder,
to continue maintaining the same or to enter upon such way or portion thereof
vacated to repair, replace, remove or otherwise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded by
�Cguncilmember Ho t , and upon vote being taken thereon, the
following voted in favor thereof: mayor Hunt, Councilmembers Davenport,
Hoyt and Neils
The following voted against or abstained: —None
Whereupon the Resolution was declared duly passed and adopted.
