The following members were present: Ma or Hunt, Counci mem ers Davenport, Hoyt and Neils The following members were absent: ouncilmember Spaeth Councilmember Neils introduced the following Resolution and moved its adopt -ion. RESOLUTION NO. 79-434 AUTHORIZING THE VACATION OF PILGRIM LANE ADJACENT TO BLOCK 5, MEDICINE LAKE PARK 3RD DIVISION WHEREAS, a petition was received to vacate Pilgrim Lane adjacent to Block 5, Medicine Lake Park 3rd Division; and WHEREAS, a public hearing with respect to said vacation was held on August 6, 1979 in accordance with Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of August 6, 1979; and WHEREAS, the Council did hold a public hearing on August 6, 1979 to inform any and all interested parties relevant to the vacation of Pilgrim Lane adjacent to Block S, Medicine Lake Park 3rd Division; and WHEREAS, it was determined by the City Council that a certain portion of Pilgrim Lane is not needed for a public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: I. That the following portion of Pilgrim Lane be vacated as public roadway: All that part of Pilgrim Lane between the Northerly and Westerly lot line of Lots 1, 2, 3 and 23, Block 5, Medicine Lake Park 3rd Division and a line described as follows: A line 60' Southeasterly of and parallel with the Southeasterly line of Lot 1 and 2, Block 1, Medicine Ridge Addition and a line 66' Southwesterly of and parallel with the Southwesterly line of Lots 1, 2 and 3, Block 2, Medicine Ridge Addition. 2. That said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace,remove or otherwise attend thereto. The motion for the adoption of the foregoing Resolution was duly seconded by' C9uncilm mb r Hoyt and upon vote being taken thereon, the OT Towing voted in favor thereof: Mayor Hunt, Councilmembers Davenport, Hoyt and Neils The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
