The following members were present: Mayor Hunt. sea Councilmember Spaeth introduced the following Resolution and moved its adoption: Resolution 79-394 APPROVING REZONING AND PRELIMINARY PLAT FOR REMBRANDT ENTERPRISES AT NORTHWEST CORNER OF I-494 AND COUNTY ROAD 9 (79025) WHEREAS, Rembrandt Enterprises has requested approval of rezoning from R-0 to B-1 and a preliminary plat and general development plan for 15 commercial lots on a 31.6 acre site at the northwest corner of I-494 and County Road 9; and WHEREAS, the Planning Commission has considered the request following a duly called public hearing and has recommended approval; aea NOW THEREFORE BE IT HEREBY RESOLVED by the City Council of the City ofl Plymouth, Minnesota, that it should and hereby does approve . a preliminary plat and general de- velopment plan dated June, 1979 for 15 commercial lots at the northwest corner of I-494 and County Road 9 subject to the following conditions: 1. Compliance with the City Engineer's memorandum for this project; 2. Provision for additional 27 feet of right-of-way for County Road 9; 3. Provision for trail easements per the approved plan; 4. Compliance with requirements of the City Attorney with respect to clarification of titles; 5. No development on any of the sites until municipal sewer and water are physically available to the sites; 6. The alignment of Berkshire Lane and County Road 9 with the street, intersection of the Criterion planned unit development to the south shall be verified by the City Engineer; 7. Removal of all dead or dying trees from the property at the owner's expense; 8. Berkshire Lane, as it enters the project and turns to the east, shall be curved rather than a right angle as indicated on the plans; 9. The west commercial properties shall be developed with substantial buffering providing a transition for the residential guided areas to the west and a detailed plan for berming and landscaping shall be provided. 10. Rezoning shall be finalized with filing of the final plat. 11. Construction of turning lanes from the east and acceleration lanes to the west on County Road 9.
