HomeMy WebLinkAboutCity Council Resolution 1979-389CITY OF PLYMOUTH Pursuant to due call and notice thereof, a reoular meeting of the City Council of the City of Plymouth, Minnesota, was held on tFi 16th day of ,Iuly, , 19 79 . The following members were present: Mayor Hunt, Councilmembers Davenport. Hoyt. Neils and Spaeth were �*w Mayor Hunt introduced the following Resolution and moved its adoption: RESOLUTION NO. 79-389 ADDING CONDITIONS TO PROPOSED DEVELOPMENT CONTRACT FOR MISSION PARTNERSHIP FOR MISSION WOODS AND MISSION HILLS PARK 6TH ADDITION, RPUD 76-1 (A-338) WHEREAS, City Council Resolution No. 78-579, Item 6, requires that the central and southwest higher density areas of RPUD 76-1 be provided with access directly to County Road 9 without passing through the single family areas; and WHEREAS, Mission Partnership has submitted final plats and plans for two develop- ments in and adjacent to the subject area, for which City staff is preparing Development Contracts to be presented to the City Council; and WHEREAS, petitioner has suggested public road access design and construction timing which would defer installation of said road to County Road 9; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and and hereby does direct the following conditions to be met and incorporated with the Development Contract for Mission Woods and Mission Hills Park 6th Addition in RPUD 76-1: 1. Completion of the street that fronts the 6th Addition (Goldenrod Lane) including the cul-de-sac. 2. The temporary access from Goldenrod Lane to Evergreen Lane between Lots 6 and 7 of the 6th Addition shall be permitted until completion of the road to County Road 9, but no later than December 31, 1982, at which time it shall be terminated and removed. 3. Dedication of necessary right-of-way for the road extension of Goldenrod.Lane to County Road 9, as approved by the City Engineer, per approved preliminary plat. 4. A written agreement shall be executed providing for waiver of public hearing for construction of that road as a 1981 City project if it is not constructed by the developer in 1981. 5. The developer shall show by mid -1980 whether the road is to be built by the developer in 1981, so that in the event it is not built, the road can be incorporated with the City Capital Improvement Program for 1981 for spring construction, if necessary; in which case road specifications and pre -payment for required utilities shall be required at that time.
