Pursuant to due call and notice thereof, a reular meeting of
the City Council of the City of Plymouth, Mih+' nsota washeld on the
` 4th day of June 19 79 . The following menhers were

Councilmember Spaeth introduced the following ?esoiution and
moved its adoption:
RESOLUTION 79-301
DENYING CONDITIONAL USE PERMIT FOR AMERICAN FAMILY FOODS AT ANNAPOLIS LANE
AND HIGHWAY 55 FRONTAGE ROAD (79031)
WHEREAS American Family Foods has requested approval of a site plan and
conditional use permit for a "Gazebo Restaurant" at the southeast corner
of Annapolis Lane and Highway 55 Frontage Road; and
WHEREAS the Planning Commission at a duly called public hearing has reviewed
the proposal and recommended denial;
NOW THEREFORE BE IT HEREBY RESOLVED by the City Council of the City of Plymouth,
Minnesota, that it should and hereby does deny the conditional use permit
and site plan for American Family Foods for a Gazebo Restaurant at Annapolis
Lane and Highway 55 Frontage Road based on the following reasons:
1. Proposed use is within the Ordinance definition of Class 2 restaurant;
2. Class 2 restaurants are not allowed in B-1 districts;
3. Site can be used for Class 1 restaurants;
4. Traffic generation and intensity would be excessive for the area;
5. Petitioner's information indicates a fastfood operation;
6. Nothing in petitioner's information confirms a traditional or Class 1
restaurant
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Ho t , and upon vote being taken thereon, the
following voted in favor thereo Mavor Hunt. Councilmembers Hovt Neils
and Spaeth
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
