Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota, was held u-n-thE 7th day of

Councilmember Spaeth introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 79-260
AUTHORIZING CONDEMNATION PROCEEDINGS
PROJECT NO. 853
VICKSBURG LANE IMPROVEMENTS FROM STATE HIGHWAY 55 TO COUNTY ROAD 9
WHEREAS, the City has undertaken Project No. 853, Vicksburg Lane Improvements
which include streets and utilities; and
WHEREAS, in order to construct the improvements certain permanent and temporary
easements are required; and
WHEREAS, the City Council finds it necessary, proper and expebient in the
interest of the public health, convenience and general welfare of the citizens
of the City of Plymouth, for the City to acquire said easenw-nts;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the City Attorney is hereby authorized to commence condemnation
proceedings for Project No. 853 for the following described easements over the
following described parcels:
1. DESCRIPTION OF PARCEL:
All that part of the East 1/2 of the Northeast 1/4 of Section 17.
Township 118, Range 22. which lies South of Rockford Road,
excepting therefrom all portions of the North 5/8ths of the South
3/5ths of the West 1/4 of the East 1/2 of the Northeast 1/4 which
lies South of Rockford Road.
DESCRIPTION OF EASEMENTS:
A perpetual easement for street and utility purposes lying over,
under, across and through the Easterly 60 feet of the above-
described parcel; and
A temporary slope easement over, under, across and through the
Westerly 40 feet of the Easterly 100 feet of the above-described
parcel.
2. DESCRIPTION OF PARCEL:
The South 220 feet of the East 495 feet of the Southeast 1/4 of
the Northeast 1/4 of Section 17, Township 118, Range 22.

DESCRIPTION OF EASEMENT:
A perpetual easement for street and utility purposes over, under, across
and through the Easterly 60 feet of the above-described parcel.
3. DESCRIPTION OF PARCEL:
The Northwest 1/4 of the Southeast 1/4 and the North 1/2 of the
Northeast 1/4 of the Southeast 1/4, and the South 3/8ths of the
West 1/2 of the Northeast 1/4 all in Section 17, Township 118,
Range 22.
DESCRIPTION OF EASEMENTS:
A perpetual easement for street and utility purposes lying over, under,
across and through the Easterly 60 feet of the above-described parcel; and
A temporary slope easement over, under, across and through the Westerly
10 feet of the Easterly 70 feet of the above-described parcel.
4. DESCRIPTION OF PARCEL:
The East 1/4 of the Northeast 1/4 of the Northeast 1/4 in Section 20,
Township 118, Range 22; and the East 1/2 of the Southeast 1/4 of the
Southeast 1/4 in Section 17, Township 118, Range 22; and the Southeast
1/4 of the Northeast 1/4 of the Southeast 1/4 in Section 17,
Township 118, Range 22.
DESCRIPTION OF EASEMENTS:
A perpetual easement for street and utility purposes lying over,
under, across and through the Easterly 60 feet of the above-
described parcel; and
A perpetual easement for street and utility purposes over, under,
across and through that portion of the above parcel described as
follows:
Commencing at the East quarter corner of Section 20,
Township 118, Range 22; thence South along the East line
of said section a digtance of 1,101.05 feet to a point;
thence deXlecting 90 West a distance of 60 feet to a point;
thence 90 Northerly along a line parallel with and 60 feet
West of the East line of said section fo!• a distance of 50
feet to a point; thence deflecting South.iesterly to a point
on the North right-of-way of Trunk Hinh%�:iy 55 located 110
feet West of the East line of said Sec :4in 20 as measured
at right angles to said East line; thence Easterly along the
North right-of-way of Trunk Highway 55 to the point of
beginning and there terminating.
5. DESCRIPTION OF PARCEL:
The South 1/2 of the Northwest 1/4 of the Northwest 1/4 of Section
21, Township 118, Range 22.

' DESCRIPTION OF EASEMENTS:
A perpetual easement for street and utility purposes lying over, under,
across and through the Westerly 60 feet of the above-described parcel;
and
A temporary slope easement over, under, across and through the Westerly
10 feet of the Easterly 70 feet of the above-described parcel.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilmember Hoyt, and upon vote being taken thereon, the following
voted in favor t ereof: Mayor Hunt, Councilmembers Hoyt, Seibold and Spaeth.
The following voted against or abstained: None.
Whereupon the Resolution was declared duly passed and adopted.
