HomeMy WebLinkAboutCity Council Resolution 1979-236CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota was held on the 23rd day of April , 19 79. The following members were present:Mayor Hunt. Councilmembers Hoyt. Neils. Seibold and Spaeth The following members were absent: None Councilmember Spaeth introduced the following Resolution and moved its adoption: RESOLUTION NO. 79-236 APPROVING SIDEYARD VARIANCE FOR DAVID JOHNSON - 350 RANCHVIEW LANE WHEREAS, Mr. David Johnson, 350 Ranchview Lane, has previously requested a two and one-half foot variance from the fifteen foot sideyard setback requirement of the City Zoning Ordinance, and WHEREAS, Mr. Johnson constructed his home assuming a two and one-half foot variance, and WHEREAS, Mr. Johnson was cited for a violation of the City Zoning Ordinance and has pleaded guilty to said offense, and . WHEREAS, the City has stipulated in return for Mr. Johnson's guilty plea to issue a variance recognizing the fact that the structure is completed, and WHEREAS, the Board of Zoning Adjustment on January 9, 1979 refused to grant a post facto variance as agreed to in such stipulation; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the City Council hereby grants to Mr. David Johnson, 350 Ranchview Lane, a two and one-half foot sideyard variance from the fifteen foot sideyard setback requirement of the City Zoning Ordinance. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Ho t 'and upon vote being taken thereon, the following vote to favor thereof.* Mayor Hunt, Councilmembers Hoyt, Neils, Seibold and Spaeth The ow ng voted against or abstained; None Whereupon the Resolution was declared duly passed and a opts ,
