HomeMy WebLinkAboutCity Council Resolution 1979-226CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of ' the City Council of the City of Plymouth, Minnesota, was held on the 16th day of April , 19 79. The following members were present: it Hunt, Gounclimembers Hoyt llowinR members were absent: Councilmember Hoyt introduced the following Resolution and moved its adoption: RESOLUTION #79-226 APPROVING LETTER OF CREDIT REDUCTION FOR FOUR SEASONS SHOPPING CENTER IN THE SOUTHWEST CORNER OF THE COUNTY ROAD 18 AND COUNTY ROAD 9 INTERSECTION (A-683) WHEREAS, Four Seasons Shopping Center (Metram Properties) has completed a portion of the landscaping as per the approved landscape plan approved by Council Reso- lution #76-583; and WHEREAS, the City Staff has inspected the landscaping and paving on site and recommends a reduction of a portion of the landscaping letter of credit to re- flect completed work and to insure the completion of all remaining improvements; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should, and hereby does, approve the request of Metram Properties for reduction of their landscaping letter of credit covering site improvements, at paid site, from $125,000.00 to $40,000.00. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils and upon vote being taken thereon, the following voted in favor thereof: Mayor Hunt, Councilmembers Hoyt, Neils and Spaeth The following voted against or abstained: one Whereupon the Resolution was declared duly passed and adopted, Pursuant to due call and notice thereof, aregular meeting of the City Council of the City of Plymouth, Minnesota was fi l don the 7th day of May , I9_ZE_. The following members were present: Mayor Hunt, Councilmembers_ Hoyt,_Seibold and Spaeth The following members were a sent: Counci member Councilmember Seibold introduced the following Resolution and moved its adoption: RESOLUTION 79-246 APPROVING CONDITIONAL USE PERMIT AND SITE PLAN FOR AUTOMOTIVE TRANSMISSION RE- PAIR FACILITY AT THE NORTHWEST CORNER OF W. MEDICINE LAKE DR. AND HWY. 55 (79024) WHEREAS W.B. Leyendecker has requested approval of a conditional use permit for an automotive transmission repair facility and approval of a site plan for the property at the northwest corner of W. Medicine Lake Dr. and Hwy. 55; and WHEREAS the Planning Commission at a duly called public hearing has reviewed the proposal and has recommended approval; NOW THEREFORE BE IT HEREBY RESOLVED by the City Council of the City of Plymouth, Minnesota, that it should and hereby does approve the conditional use permit and site plan for W.B. Leyendecker for an automotive transmission repair facility at the northwest corner of W. Medicine Lake Dr. and Hwy. 55 subject to the following conditions: 1. The conditional use permit is subject to all applicable codes, ordinances, and regulations and violation thereof shall be grounds for revocation; 2. The conditional use permit is issued to the petitioner as operator and is non-transferrable; 3. A site performance guarantee for all approved improvements for a period of 18 months will be submitted prior to issuance of the conditional use permit; 4. Petitioner shall secure from Hennepin County the necessary permits for the curb cut modifications; 5. Parking and/or storage of unlicensed or inoperable vehicles shall be prohibited except for vehicles being serviced; 6. Detailed sign plans shall be submitted to the Commission for review and approval prior to issuance of sign permits; 7 Front yard setback to parking spaces along the south boundary is acknowledged' in consideration of the large existing highway right-of-way green strip and the petitioner's installation of concrete curbing along said boundaries; a 10' yard setback variance for parking spaces is acknowledged along the east boundary unless it is determined the parking spaces are not needed for the use, in which case the full 20' yard setback shall be provided; 8. Storage and display of parts or merchandise outside the building or approved enclosures is expressly prohibited; 9. There shall be no painting, welding, body work, mechanical repairs (other than transmissions) or retail sales; 10. The permit shall be for a one year period. u
