the City Council of the City of Plymouth, innesota was a on the

Councilmember Hoyt introduced the following Resolution and
moved its adoption:
RESOLUTION NO, 79-215
AMENDING DEVELOPMENT CONTRACT FOR ROBERT MIDDLEMIST FOURTH ADDITION (A-718)
WHEREAS, the City Council under Resolution No. 79-183 adopted on April 2, 1979
approved the final plat and development contract for Robert Middlemist Fourth
Addition, a plat for 12 single family lots in the southeast quadrant of
Zachary Lane and County Road 9; and,
WHEREAS, the petitioner has requested reconsideration of the development contract
Particularly with respect to item 2.1(b) relative to the widening of Zachary Lane;
THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Ply-
moutn, Minnesota, that it should and hereby does approve the amendment of the
development contract for Robert Middlemist Fourth Addition by deleting Item
2.1(b) requiring widening and construction of Zachary Lane noting that the
change in the development contract is based on the circumstances that this is
the last addition to be developed and the developer was not advised of this
policy of the City until the time development of this last parcel was proposed,
and, further, that the plat has no street access to Zachary Lane,
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Neils , and upon vote being taken thereon, the
following vote n favor t ereo : _Mayor Hunt, Councilmembers. Hoyt. Npilc_
Spaeth and Siebold
