Pursuant to due call and notice thereof, a ire ul'ar meeting of
the City Council of the City of Plymouth, inneM' sota was h—MF on the
19th day of March '979 . The following members were
present: h,?ayor Hunt, Councilmembers Hoyt, Seibold and Spaeth
The following members were absent: Councilmember Neils
Councilmember Spaeth introduced the following Resolution and
moved its adoption:
CORRECTED RESOLUTION NO. 79-149
AUTHORIZING VACATION OF
PERIPHERAL ROAD SOUTHERLY OF 13TH AVENUE
WHEREAS, a petition to vacate Peripheral Road from 13th Avenue to County No. 15
has been received by the City Council from the property owner; and
WHEREAS, a public hearing with respect to said vacation was held on March 19,
1979 in accordance with Minnesota Statutes, 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of March 19, 1979; and
WHEREAS, the Council did hold a public hearing on March 19, 1979 to inform any
and all interested parties relevant to the vacation of Peripheral Road from 13th
Avenue to County No. 15; and
WHEREAS, it was determined by the City Council that a portion of Peripheral Road
from 13th Avenue southerly is not needed for a public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTM'
MINNESOTA, as follows:
1. That part of Peripheral Road as platted in said Carlson Companies
Addition, lying southerly of the southwesterly extension of the
northwesterly line of said Lot 1 and which lies northerly of a
line 913.93 feet southerly of and parallel with a line hereinafter
referred to as Line A, which is drawn at a right angle to the most
easterly line distant 865.14 feet southerly from the most north-
easterly corner of said Lot 1, as measured along the easterly line
of said Lot 1.
2. That said vacation shall not affect the authority of any person,
corporation or municipality owning or controlling electric or
telephone poles and lines, gas and sewer lines, or water pipes, mains
and hydrants thereon or thereunder, to continue maintaining the same
or to enter upon such way or portion thereof vacated to repair,
replace, remove or otherwise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded by'
Councilmember Seibold , and upon vote being taken thereon, the
following voted in favor t ereo Mayor Hunt, Councilmembers Hoyt and Spaeth

Whereupon the Resolution was declared duly passed and adopted.
