The following members were present: Mayor Hun Cg ilmembers Hoyt, Neils and Spaeth The following me emb rs were absent: Councilmember Seibold Councilmember Spaeth introduced the follow -Ing Resolution and moved its adoption: RESOLUTION 79-124 APPROVING CONCEPT PLAN FOR HIXON PROPERTIES OF "PLYMOUTH CREEK" RPUD AT S.E. CORNER OF ROCKFORD ROAD AND VICKSBURG LANE (79006) WHEREAS, Hixon Properties has requested approval of a concept plan for 135 town- houses on Outlot A, and 270 apartment units on Outlot C at southeast corner of Rockford Road and Vicksburg Line; and WHEREAS, the Planning Commission has reviewed said request and recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA,, that it should and hereby does, approve the request of Hixon Properties for concept plan approval of "Plymouth Creek" consisting of 135 townhouses on Outlot A and 270 apartment units on Outlot C, to be located at the southeast corner of Rockford Road and Vicksburg Lane, subject to the following conditions: 10 1. Adjustment of roadway access points on Vicksburg Lane and on new County Road 9 as per City Engineer's memorandum. 2. Compliance with Section 6 of the Zoning Ordinance relative to subdivision and development in the General Flood Plain District. 3. The burden of providing substantial effective buffering along Vicksburg Lane, new County Road No. 9, and Rockford Road, with particular emphasis on providing transition to the west and to the north, is the developer's. 4. The development grading, drainage and ponding will be consistent with the guidelines set forth in the Related Area Environmental Assessment Worksheet prepared for Plymouth Hills. 5. Satisfaction of park dedication requirements in accordance with City Policy Resolution 78-661. 6. Any units lost due to the impact of the flood plain regulations on Outlot A shall not be transferred to other portions of the site. 7. A copy of the Concept Plan map shall be attached to the approving resolution. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Hoyt , and upon vote being taken thereon, the o Ow ng voted in tayor thereof, Mayor Hunt, Councilmembers Hoyt, Neils and S aeth , 0 ow ng voted against or abstained; one Whereupon the Resolution was declared duly passed and adopted,
