The following members were present: Mayor Hunt Councilmembers Hoyt, Neils and Seibold The following members were absent- ounce mem er Spaeth Councilmember Seibold introduced the following Resolution and moved its adoption: RESOLUTION NO. 79- 104 RESCINDING RESOLUTION 78-626 PROJECT 718 ASSESSMENTS WHEREAS, the City Council did on the 2nd day of October, 1978, adopt Resolution No. 78-626 adopting an assessment roll for Project No. 718, Timber Creek Addition, and Whereas, an assessment was levied for said project against Lots 6 and 7, Auditor's Subdivision No. 333 (Plat 43740 Parcel 1503), Hennepin County, Minnesota, owned by Mr. Thomas Harty, and WHEREAS, a check of the records of said project indicates that the owner, Mr. Thomas Harty, was not mailed a notice of the special assessment hearing concerning said Project No. 718, and . WHEREAS, failure to mail said notice to Mr. Harty makes the assessment levied against his property invalid. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That Resolution No. 78-626 adopted by the City Council on October 2, 1978 pertaining to Lots 6 and 7, Auditor's Subdivision No. 333 (Plat 43740 Parcel 1503), Hennepin County, Minnesota is hereby rescinded. 2. The City Manager is hereby directed to cause a certified copy of this resolution to be forwarded and filed with the appropriate officers of Hennepin County to effect a recision of said resolution as it pertains to said property. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils and upon vote being taken thereon the following voted in favor thereofMayor Hunt, Councilmembers Hoyt, Neils and Seibold The following vote against or abstained: one Whereupon the Resolution was declared duly passed and adopted.
