CITYOF PLYMOUTH
Pursuant to due call and notice thereof, a regular meeting of the City Council
of the City of Plymouth, Minnesota was held on the 5th day of February, 1979.
The following members were present: Acting Mayor Spaeth, Councilmembers Hoyt,
Neils and Seibold. The following mem ors were absent: Mayor iunt.
Councilmember Seibold introduced the following Resolution and moved its adoption:
RESOLUTION NO. 79-85A
AUTHORIZING CONDEMNATION PROCEEDINGS
PROJECT 804
FERN BROOK LANE
WHEREAS, the City has undertaken Project 804, which includes
streets, sanitary sewer, water main and a walk way and Bridge,
and
WHEREAS, in order to construct the improvements,
certain permanent and temporary easements are required; and
WHEREAS, the City Council finds it necessary, proper
and expedient in the interest of the public health, convenience
and general welfare of the citizens of the City of Plymouth,
for the City to acquire said easements;
NOW THEREFORE, BE IT HEREBY RESOLVED_BY THE CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA, the the City Attorney is
hereby authorized and directed to commence condemnation pro—
ceedings for Project No 804 for the following described ease—
ments over the following described parcels:
Description of Parcel:
The Northwest Quarter of the Northeast Quarter of Section 21,
Township 118, Range 22, Hennepin County, Minnesota. ALSO
The Northeast Quarter of the Northeast Quarter of said Section 21,
except that part described as follows:
Description of Easements:
A permanent easement for utility purposes over, under, across
and through part of the above-described parcel describod is
follows:
A strip of land 20 feet in wid,h, 10 feet on e.ithor
side of the following described line:
Commencing at the Northwest corner of Section 22,
Township 118, Range 22; thence on an assumed
bearing of South 0 degrees, 46 minutes, 33 seconds
West along the West line of the Northwest 1/4 of
said Section 22 a distance of 250.00 feet to the
point of beginning of the Zine to be described;
thence North 89 degrees West 285.00 feet to a
point; thence North 23 degrees 20 minutes West
243.0 feet to a point; thence North 86 degrees,
45 minutes West, 190.0 feet to a point; thence
North 50 degrees, 10 minutes West to a point on
the North line of the Northeast 1/4 of the North-
east 1/4 of Section 21, Township 118, Range 22 and
there terminating; and
A oermanent easement for utility purposes over, under, across and
through a strip of land 20 feet wide, 10 feet on either side of
that portion of the above-described line lying within said North-
west 1/4 of the Northeast 1/4 of Section 21, Township 118, Range 22:
Commencing at the Northwest corner of Section 22,
Township 118, Range 22; thence on an assumed bearing
of south 0 degrees 46 minutes 33 seconds West along
the West line of the Horthwest 1/4 of said Section
22, a distance of 250.00 feet to the point of
beginning of the line to be described; thence North
89° West for a distance of 785.0 Feet to a point;
thence North 23 degrees 20 minutes West for a dis-
tance of 243.0 feet to a point; thence North 86
degrees 45 minutes West a distance of 190.0 feet;
thence North 50 degrees 10 minutes West a distance
of 720.0 feet to a point; thence South 76 degrees
West 161.0 feet; thence South 87 degrees 32 minutes
West a distance of 239.02 feet to a point; thence
South 82 degrees 15 minutes West for a distance of
588.31 feet to a point; thence South 23 degrees
West for a distance of 203.0 feet to a point;
thence South 0 degrees 30 minutes West for a dis-
tance of 406.00 feet to a point; thence South 29
degrees East a distance of 260.0 feet to a point;
thence South 0 degrees 41 minutes 23 seconds West
a distance of 402.0 -feet to a point; thence South
30 degrees West a distance of 180.0 feet and there
terminating; and
A permanent easement for bridge and walkway purposes I—er, under,
across and through that part of the above-described F— cel,
described as follows:
Commencing at the Northeast corner of the
Northeast 1/4 of the Northeast 1/4 of Section 21,
Township 118, Range 22; thence Southerly along
the East line of Section 21, for a distance of 356
feet to a point; thence South, parallel with the
North line of said section a distance of 33 feet
to the actual point of beginning of the parcel to
be described; thence Southerly, parallel with the
East line of Section 71 a distance of 50 feet to

a point; thence. Westerly parallel with tho North
line of Section 21 a distance of 6o feet to a
point; thence Northerly, parallel with tho Li'ast
line of said section a distance of 50 feet; and
thence Easterly a distance of 60 fret to the point
of beginning; and there terminatinj; and
A permanent street and utility easement consisting of a strip of
land 80.0 feet wide centered over the following described line:
Commencing at the Northwest corner of the Northwest
1/4 of the Northeast 1/4 of Section 21, Township 118,
Range 22, thence Southerly along the West line of
said Northwest 1/4 of the Northeast 1/4 for a distance
of 944.94 feet to the actual point of beginning; thence
Southeasterly along a circular curve whose tangent
line is perpendicular to the said West line and having
a central angle of 300 00' and a radius of 881.50
feet for a distance of 428.57 feet to a point of
reverse curvature, thence deflecting to the Northeast
along a tangential circular curve having a central
angle of 450 00' and a radius of 818.50 feet for a
distance of 125.00 feet and there terminating; and
A temporary easement for c=struction purposes lying over, under,
and through that portion of the above-described _parcel which is
described as follows:
Commencing at the Northeast corner of the Northeast
1/4 of the Northeast 1/4 of Section 21, Township 118,
Range 22; thence Southerly along the East line of Sec-
tion 21 for a distance of 225 feet to the actual
point of beginning; thence Westerly parallel to the
North line of Section 21 for a ..istance of 70 feet;
thence Southerly parallel to the East line of
Section 21 for a distance of 467.02 feet; thence
Easterly parallel to the North line of Section 21 to
a point on the East line of Section 21; thence
Northerly along the East line of Section 21 to the
point of beginning and there terminating.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Hoyt, and upon vote being atken thereon, the following voted in

thereof: Acting Mayor Spaeth, Councilmembers Hoyt, Neils and Seibold.
The following voted against or abstained: None.
Whereupon the Resolution was declared duly passed and adopted.
