Spihold and Spaeth The following members were absent: Mayor Hunt kkk +kkk Councilgcmber Seibold introduced the following Resolution and moved its adoption: RESOLUTION 19- 80 kkk ESTABLISHING POLICY REGARDING MINIMUM FLOOR ELEVATIONS FOR NEW STRUCTURES IN SUBDIVISIONS OR ON SITES ADJACENT TO OR CONTAINING ANY OPEN STORM WATER DRAINAGE FACILITY WHEREAS, the City has adopted for the purpose of protecting public and private structures form the hazards of flooding and high water, various guidelines and regulations, including a storm water drainage plan, the State Building Code and Zoning Ordinance requirements for flood plain areas based upon the Federal flood insurance study for the City; and WHEREAS, the City Council finds it necessary to assure that developers and builders are aware of the minimum floor elevation requirements set forth in those guide- lines and regulations; and, that structures built in the City meet those floor elevation requirements when constructed; and WHEREAS, such determination and verification of required floor elevations can be reasonably accomplished within the normal plan approval and construction process by the developer or builder without undue burden or cost; NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does establish the following as policy requiring the determination, specification, and verification of minimum floor elevation for new structures built in any subdivision or on any site adjacent to or containing any open storm water drainage facility: I. Developers and others proposing the subdivision of land for residential use shall submit with the record plat a print of the approved subdivision showing the proposed lowest floor elevation for each dwelling and the established high water elevation for the area as approved by the City Engineer. 2. The certified survey and plot plan or site plan submitted with the building permit application for all buildings shall indicate the proposed lowest floor elevation of the proposed building and the established high water elevation and lowest floor minimum elevation as approved by the City Engineer. 3. The approved lowest floor minimum elevation shall be no less than 2 feet above the established 100 -year flood plain elevation as determined by the City storm water drainage map and/or the Federal flood insurance map, subject to approval by the City Engineer. An "as -built" survey, certified by a Minnesota registered civil engineer or surveyor, shall be submitted to the Building Official indicating the elevation of the lowest floor level and the top of the installed founda- tion wall for those sites which abut lakes, ponds, streams, and/or surface water drainage routes,and therefore are deemed to be subject to flooding and high water damage. The survey and certification shall be compared to the established minimum elevations and approved by the Building Official prior to any further construction above the foundation wall. Should the submitted survey data indicate that the installed floor elevation would be less than the approved required elevation, the Building Official shall require appropriate corrective measures before any further construction beyond the foundation walls is permitted.
