HomeMy WebLinkAboutCity Council Resolution 1979-034CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on t e 15th day of January , 1979 . The following members were present•. Mayo aunt, Councilmembers Hoyt, Se,bold and Spaeth The following members were absent: Councilmember Neils Councilmember Spaeth introduced the following Resolution and moved its adoption: RESOLUTION NO. 79-34 AUTHORIZING VACATION OF A PORTION OF CHESHIRE LANE NORTH OF 21ST AVENUE WHEREAS, a petition to vacate a portion of Cheshire Lane north of 21st Avenue has been received by the City Council from the property owner; and WHEREAS, a public hearing with respect to said vacation was held on January 15, 1979 in accordance with Minnesota Statutes, 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of January 15, 1979; and WHEREAS, the Council did hold a public hearing on January 15, 1979 to inform any and all interested parties relevant to the vacation of a portion of Cheshire Lane north of 21st Avenue; and WHEREAS, it was determined by the City Council that that portion of Cheshire Lane north of 21st Avenue is not needed for a public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, as follows: 1. That part of Cheshire Lane, as dedicated in Belmar's Industrial Park, according to the recorded plat thereof, lying northerly and easterly of the circumference of a circle with a radius of 60.00 feet the easterly right-of-way of said Cheshire Lane being tangent to said circle and the center of said circle is the intersection of the center- line of 21st Avenue North, as dedicated in said Belmar's Industrial Park and the westerly right-of-way of said Cheshire Lane is hereby vacated. 2. That said vacation shall not affect the authority of any person, corporation or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove or other- wise attend thereto. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Seibold , and upon vote being taken thereon, the 0 owing voted in Tavor ereof: Mayor Hunt, Councilmembers Hoyt, Seibold and Spaeth___ ine following voted against or abstained: Whereupon the Resolution was declared duly *,rx oprea. *,r,r
