HomeMy WebLinkAboutCity Council Resolution 1979-026CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 8th day of January, 1979. The following members were present: The following members were absent: Councilmember Seibold introduced the following Resolution and moved its adoption: RESOLUTION NO. 79-26 AUTHORIZING CONDEMNATION PROCEEDINGS, PROJECT NO. 804, FERNBROOK ILANE WHEREAS, the City has undertaken Project No. 804, Fernbrook Lane Improvement, which includes street improvements and a pedestrian walkway: and WHEREAS, in order to construct the improvements, certain permanent easements are required, and WHEREAS, the City Council finds it necessary, proper and expedient in the interest of the public health, convenience and general welfare of the citizens of the C=*,y of Plymouth, for the City to acquire said easements. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL or THE CITY OF PLYMOUTH, MINNESOTA, that the City Attorney is hereby authorized to commence condemnation proceedings for Project No. 804 for the following described easements over the following described parcel: Description of Parcel: The North 100 ;feet of.the Northeast: l/4 of the Northeast 1/4., also` that` part. of the Northeast=.-. 1/4- of the.Nor'theast,l/4llying South of the North 100 feet and West of the 'East '250 feet and that part of the East 250 feet of the Northeast 1/4 of the Northeast 1/4., lying South of the North 225 feet and the Northwest l/4 of the Northeast 1/4, all. +in Section'21, Township 118, Range 22: r eta r Description of Easements: A permanent easement for bridge and walkway purposes over, under, across and through that portion of the above-described parcel which is described below: Commencing at the Northeast corner of the Northeast 1/4 of the Northeast 1/4, Section 21, Township 118, Range 22; thence southerly along the East line of Section 21 for a distance of 358.0 feet; thence West at right angles for a distance of 33.0 feet to actual point of beginning; thence continuing West for a distance of 60.0 feet; thence South at right angles for a distance of 50.0 feet; thence East at right angles for a distance of 60.0 feet; thence North at right angles for a distance of 50.0 feet to actual point of beginning and there terminating, Section 21, Township 118, Range 22; and A temporary construction easement across the West 70.0 feet of the East 103.0 feet of the above-described parcel. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following voted in favor thereof: The following voted against or abstained: Whereupon the Resolution was declared duly passed and adopted.
