HomeMy WebLinkAboutCity Council Resolution 1978-854J ITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 18th day of December , 1978 . The following members were present: Mayor .,int, Councilmembers Hoyt, Neils, Seibold and Spaeth The following members were absent: None Councilmember Spaeth introduced the following Resolution and moved its adoption: RESOLUTION NO. 78-854 REQUEST FOR PAYMENT NO. 6 AND FINAL PROJECT NO. 706 - LARCH LANE AND 49TH AVENUE WHEREAS, the City of Plymouth as Owner and Bury and Carlson as Contract, _Jr have entered into an agreement for the improvement of the Larch Lane and 49th Avenue project by the construction of street, watermains and all necessary appurtenances, said Agreement being dated July 26, 1977, and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the Final Request for Payment, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $311,034.85; Change Order Nus. 1 - 4 were approved in the amount of $22,541.68, making a revised cnntract amount of $333,576.53 and the value of the work completed to date is $328,762.49. 2. That the work performed by the Contractor for Project No. 706 and certified to the Council by the Engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the owner, required qua rantecs and Correction of Faulty Work after Final Payment. 3. Request for Payment No. 6 and Final in the amount of $37,624.00 to Bury and Carlson for Project No. 706 is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Collor and upon vote being taken therein, the following vote in avor ereo : Mavor Hunt- Councilmembers Hoyt Ngils_ i eth The R? d and Spa owing voted against or abstained: None Whereupon the Resolution was declared duly passed and adopte .
