Neils and Spaeth The following members were absent: Councilmember 5,gibold `^" r Ne? is introduced the following Resolution and move its adoption: RESOLUTION #78-824 DENYING CONDITIONAL USE PERMIT AND SITE PLAN BY JAMES THOMPSON FOR SUPER AMERICA STATIONS AT NORTHWEST CORNER OF HWY. 55 & W. MEDICINE LAKE DRIVE (A-404) WHEREAS, James Thompson has requested for Super America Stations approval of conditional use permit and site plan for a retail sales use and gasoline sales at the northwest corner of Hwy. 55 & W. Medicine Lake Road; and WHEREAS, the Planning Commission has reviewed said request and recommended denial; NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does, deny the request of James Thompson for conditional use permit and site plan for Super America Stations for a retail sales use and gasoline sales at the northwest corner of Hwy. 55 & W. Medicine Lake Drive, for the following reasons: I. The previous conditional use permit for a gasoline service station on the site is not transferable, and the proposed retail use differs substantially from that use. 2. Retail activity such as the proposed use would have an adverse impact upon the site and the adjacent neighborhood, especially with respect to hours of operation and traffic generation. 3. There are a variety of permitted uses in the B-3 district which would be adaptable to the site and which would not be detrimental to the property or to the area; the owner has not proposed such permitted uses. 4. The character of the proposr-J uFe is not deemed consistent with the Conditional Use Standards in Section 9 of the Zoning Ordinance as evidenced by the intensity and by the variances proposed as essential to the use.
