Pursuant to due call and notice thereof, as ec.1 meeting of the City
Council of the City of Plymouth, Minnesota, was ie on t 27th day of
November , 19 78. The following members were present: Mayor Hunt,
Councilmembers Hoyt, Neils, Seibold and Spaeth

Councilmember Hoyt introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 78-786
AUTHORIZING VACATION OF A PORTION OF
OLD COUNTY ROAD 9 RIGHT-OF-WAY WESTERLY OF LANCASTER LANE

WHEREAS, a petition to vacate old County Road 9 right-of-way westerly of Lancaster
Lane has been received by the City Council from the property owner; and
WHEREAS, a public hearing with respect to said vacation was held on November 27,
1978 in accordance with Minnesota Statutes, 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of November 27, 1978; and
WHEREAS, the Council did hold a public hearing on November 27, 1978 to inform any
and all interested parties relevant to the vacation of old County Road 9 right-of-
way westerly of Lancaster Lane; and
WHEREAS, it was determined by the City Council that that portion of old County Road
9 right-of-way westerly of Lancaster Lane is not needed for a public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, as follows:
That part of old Hennepin County Road No. 9 in part of Section 13,
Township 118, Range 22, Hennepin County, Minnesota, lying westerly
of the northerly extension of the westerly right-of-way of Lancaster
Lane, as platted in Plymouth Plaza 4th Addition, and lying easterly
and southerly of the following described line: Beginning at a point
on the northerly lot line of Lot 4, Block 5, Plymouth Plaza 2nd
Addition, distant 46.35 feet westerly of the northeast corner of
said Lot 4 (said northerly line has assumed bearing of N 88 degrees
26 minutes 06 seconds E); thence N 41 degrees 33 minutes 47 seconds
E, a distance of 58.50 feet more or less, to the south line of
Hennepin County State Aid Highway No. 18, Plat 32; thence easterly
along said southerly line of C.S.A.H. No. 18 to its intersection with
the northerly extension of the westerly right-of-way of said Lancaster
Lane and there terminating.

2. That said vacation shall not affect the authority of any person,
corporation or municipality owning or controlkI ng electric or telephone
poles and lines, gas and sewer lines, or water pipes. mains and hydrants
thereon or thereunder, to continue maintaining the.same or to enter upon
such way or portion thereof vacated to repair, replace, remove or other-
wise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilmember Seibold , and upon vote being taken thereon the
fol owing
