HomeMy WebLinkAboutCity Council Resolution 2009-250CITY OF PLYMOUTH RESOLUTION No. 2009-250 A RESOLUTION APPROVING A PUD GENERAL PLAN FOR CENTEX FOR ELM CREEK HIGHLANDS ON PROPERTY LOCATED AT THE NORTHEAST CORNER OF PEONY LANE AND SCHMIDT LAKE ROAD (2009046) WHEREAS, Centex has requested approval of a PUD general plan for the property legally described as follows: That part of the East One Half of the Northeast Quarter (NE '/4) of Section 7, Township 118, Range 22, Hennepin County, Minnesota lying southerly of the following described line: Commencing at the southeast corner of the Northeast Quarter of said Section 7; thence North 00 degrees 20 minutes 49 seconds East 508.30 feet to point of beginning of said line; thence North 89 degrees 39 minutes 18 seconds West 98.51 feet; thence North 02 degrees 49 minutes 04 seconds West 57.31 feet; thence North 67 degrees 59 minutes 35 seconds West 147.98 feet; thence North 54 degrees 24 minutes 41 seconds West 107.61 feet; thence North 36 degrees 37 minutes 01 seconds West 117.24 feet; thence North 41 degrees 20 minutes 41 seconds West 89.53 feet; thence North 73 degrees 03 minutes 51 seconds West 89.29 feet; thence North 86 degrees 19 minutes 22 seconds West 91.66 feet; thence North 69 degrees 08 minutes 56 seconds West 74.52 feet; thence North 09 degrees 46 minutes 05 seconds West 153.34 feet; thence North 00 degrees 13 minutes 46 seconds West 133.33 feet; thence North 52 degrees 00 minutes 55 seconds West 283.18 feet; thence South 72 degrees 20 minutes 38 seconds West 305.08 feet; thence North 89 degrees 31 minutes 38 seconds West 60.00 feet to the west line of the East One Half of the Northeast Quarter (NE '/4) of said Section 7 and there terminating. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does approve the request by Centex for a PUD general plan, subject to the following conditions: 1. A PUD general plan is approved to allow a 70 -lot single-family subdivision to be called Elm Creek Highlands, according to the plans received by the City on August 6, 14, and 20, 2009, except as amended by this resolution. 2. Approval of this PUD general plan is contingent upon City approval of the associated Comprehensive Plan amendments, rezoning, and wetland mitigation plan. 3. Development standards shall be as indicated on the plans and materials dated August 6, 14, and 20, 2009, except as amended by this resolution. Resolution 2009-250 File No. 2009046 Page 2 4. The following setbacks shall apply: a. A 25 -foot building setback measured from the rights-of-way of all local streets. b. A 25 -foot rear building setback. c. A 5 -foot side -yard building and stricture setback for living area, garages and other strictures and improvements. d. A 15 -foot stricture setback from the wetland buffers, except that uncovered decks and at - grade patios may be located up to nine feet from the wetland buffer and retaining walls are permitted within the setback to the wetland buffer. e. A 40 -foot building setback from the Schmidt Lake Road and Peony Lane rights-of-way. f. No buildings or strictures shall be constricted within drainage and utility easements without the approval of the City Engineer. g. Other strictures and improvements shall be reviewed consistent with Section 2115.04 of the Zoning Ordinance. 5. No building permits shall be issued until a PUD final plan is approved by City staff. 6. As part of the PUD final plan application, the applicant shall submit the following plans and materials consistent with the City Code, Zoning Ordinance, Engineering Guidelines and other requirements: a) Submit the specifications of the fence to be installed at the top of the retaining walls along Schmidt Lake Road and outside the wetland buffers. b) Revise the landscaping plan to 1) plant sod instead of the seed mixture as proposed in the southwest corner of the property; and 2) add salt -tolerant landscaping consistent with the sketch plan submitted on September 3, 2009. No plantings shall be permitted within a 30 -foot visibility triangle measured from the intersection of the adjacent trails. 7. Prior to issuance of a building permit, the applicant shall submit the following plans and materials: a) A certified survey for each lot that includes the location, size and specie of the two overstory trees to be planted in the front yard. b) Any retaining walls to be installed on the property or on the property lines must be shown on the survey. No installation of retaining walls shall be permitted in drainage and utility easements without approval from the City Engineer and an encroachment agreement. 8. All signage shall require separate permits and shall be in conformance with Section 21155 in the Zoning Ordinance. APPROVED THIS 13TH DAY OF OCTOBER, 2009.
