HomeMy WebLinkAboutCity Council Resolution 1978-758CITY OF PLYNOM Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was field on t e 20th day of November , 19 78. The following members were present: Mayor Hunt. —Councimembers Hoyt Neils Seibold and Spaeth Me following members were sent: None introduced the following Resolution and moved itstion: RESOLUTION 78- 758 APPROVING CONDITIONAL USE PERMIT, PRELIMINARY PLAT/PLAN, AND REZONING FOR MPUD 78-1 FOR CRITERION HOMES, INC. (A-814) WHEREAS, Criterion Homes his requested approval of conditional use permit, prelim- inary plat/plan, and rezoning for MPUD 78-1, at the southeast quadrant of County Road 9 and Fernbrook Lane; and WHEREAS, City Council Res. 78-248 approved MPUD 78-1 concept plan for Criterion Homes, Inc.; and WHEREAS, she Planning Commission has reviewed said request and recommends its approval; NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve conditional use permit, preliminary plat/plan, and rezoning for MPUD 7^-1 for Criterion Homes, Inc., at the southeast quadrant of County Road 9 and Fernbrook Lane, subject to the following conditions: 1. The trail corridor from the south boundary (approximately 36th Ave. No.) north to the north property line of Lot 1, Block 3 be eliminated, with this land to be incorporated into adjacent properties for landscaping purposes as buffering between the residential and commercial development. 2. Dedicated trail corridors to be designated as indicated on the corridor use plan adopted November, 1976, with the cross community trail (multiple use) to be along I-494 adjacent and within the powerline easement; and the local trail to be within the Fernbrook Lane dedicated right-of-way. 3. A trail strip as indicated on the graphic dated September 19, 1978 between 39th Ave. No. and 40th Ave. No. east of Lot 12, Block 1 and along the west sire of Block 8 shall be dedicated for local trail use. 4. The front yard setback of typical residential lots shall be 35' with a minimum 6' side yard setback; and all other vard setbacks shall be as shown per graphic sheet #1 dated November 8, 1978. Specific typical yard setbacks shall be shown on plan at time of final pleating. 5. Compliance with the City Engineer's memorandum for this project. 6. Payment of Park Dedication fees -in -lieu of dedication shall be made according to adopted City Council policy at time of development. 7. Appropriate easements for right-of-way and drainage purposes shall be made as approved by the City Engineer. W W Resolution 0 78-758 Page 2 8. The area on the west side of Block 8 north of 40th Ave. No. and on the west and south side of the proposed Annapolis Lane right-of-way south of County Road 9 shall be landscaped per graphics dated September 19, 1978; the area along the west of Block 8 between 40th Ave. No. and Annapolis Lane to be extension of the trail per Condition No. 3. 9. Access to the commercial sites adjacent to County Road 9 shall be solely from Annapolis Lane, 10. A concept graphic reflecting the final approval shall be attached to all purchase agreements for properties within the MPUD; and all covenants and filings per Section 9 of the Zoning Ordinance shall be subject to approval by the City Attorney. 11. The landscaping treatment north of 40th Ave. No. to Annapolis Lane shall include double the amount of spruce trees which shall be 8' in height. 12. The dedicated trail corridor south of County Road 9 within and adjacent to the Annapolis Lane right-of-way shall be classified "Residential" for purposes of determining yard and building setbacks for the commercial and industrial sites to the east.
