Pursuant to due call and notice thereof, a regular meetino of
the City Council of the City of Plymouth, Minnesota was held on the V
6th day of NovPmher , 19 78. The following members were
present: Mayor Hunt Councilmembers Hoyt,elTlli s, Seibold and Spaeth
The following members were a sent: one
Councilmember Neils introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 78- 737
REQUEST FOR PAYMENT NO. 4 and FINAL
PROJECT NO. 605-002 RFSERVOIR NO. 4 LANDSCAPING
WHEREAS, the City of Plymouth as Owner and Natural Green, Inc. as Contractor
have entered into an agreement for the landscaping of Water Reservoir No. 4, said
Agreement being dated October 4, 1977, and
WHEREAS, the Entineer has certified his acceptance of the work and his approval
of the Final Request for Payment,
NOW, THEREFOR4 BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the original contract amount was $13,866.00; Change Order No. 1
was approved in the amount of $760.00, making a revised contract amount
of $14,626.00 and the value of the work completed to date is $14,626.00.
2. That the work performed by the Contractor for Project No. 605-002 and
certified to the Council by the Engineer as acceptable be and the'same
is hereby accepted as of November 6, 1978. The Contractor is hereby
released from the contract except as to the conditions of the Performance
Bond, any and all legal rights of the owner, required guarantees and
Correction of Faulty Work after Final Payment.
3. Request for Payment No. 4 and Final in the amount of $400.00 for
Project No. 605-002, Water Reservoir No. 4 Landscaping is hereby approved
and the City Finance Director is hereby authorized and directed to pay
the same forthwith.
